Judge Won’t Dismiss Case, May Punish David Daleiden for Exposing Planned Parenthood Baby Part Sales

Planned Parenthood’s real crime of profiting from their unspeakable actions is brushed aside by the California prosecutors.

Daleiden could be sent to jail for the so-called “crime” of exposing Planned Parenthood’s allegedly illegal sales of aborted baby body parts and alleged murder of born-alive infants. He and fellow Center for Medical Progress investigator Sandra Merritt face multiple felony charges for invasion of privacy in California.

The pro-abortion news outlet Rewire reports federal Judge Christopher Hite accused Daleiden of “criminal activity” Tuesday when he refused to dismiss a 2016 search warrant for Daleiden’s apartment issued by then-California Attorney General Kamala Harris.

Defense lawyers argued that the search warrant was politically motivated, and Harris worked closely with Planned Parenthood officials to prosecute Daleiden after he exposed their horrific abortion practices. Harris, now a Democratic presidential candidate, also accepted huge campaign donations from the abortion chain.

But Hite refused to dismiss the warrant, writing: “Even assuming Daleiden was a journalist at the time of the recordings his actions would not be protected by the California Shield Law or the Federal Privacy Protection Act under the circumstances alleged in the search warrant. While this newfound freedom of information and speech brings about different perspectives and discussions, it does not give either the media or a citizen journalist free reign to violate criminal laws applicable to the general public.”

Though Hite did not issue a final ruling on whether the case should proceed to trial, Rewire predicted that a full trial appears likely.

The Center for Medical Progress said testimony from the preliminary hearing demonstrates that Planned Parenthood, not Daleiden and Merritt, is the one that should be prosecuted.

“There was never any legal reason to prosecute CMP investigators for recording public conversations,” the group said in a statement Wednesday. “This sham case was launched by dirty political dealings between Planned Parenthood and Kamala Harris and must be thrown out, so the justice system can finally focus on the real criminals who sold baby body parts.”

“The threat of this prosecution is in the threat of finding that undercover investigations and recording in place where people could generally overhear your conversation, or in blurring the line so much that journalists or investigators won’t ever record because the threat of prosecution could wax and wane from second to second,” Matthew Strugar, a First Amendment attorney in Los Angeles told the news outlet.

Even Rewire, which reports from a pro-abortion perspective, acknowledged that Daleiden’s prosecution could have serious “repercussions” for all undercover journalists.

No other journalists have been prosecuted for similar undercover investigations under California law, Daleiden’s and Merritt’s defense lawyers contend.

The preliminary hearing began two weeks ago with a witness for the abortion industry admitting that the Center for Medical Progress (CMP) videos were “not altered.” Then, a biotech company CEO who worked with Planned Parenthood could not deny that they harvested aborted babies’ hearts while they were still beating. The hearing will determine whether the case should go to a full jury trial.

StemExpress CEO Admits Selling Beating Baby Hearts, Intact Baby Heads in Daleiden Hearing

The CEO of StemExpress essentially admitted in court Thursday that her biotech company supplies beating fetal hearts and intact fetal heads to medical researchers.

She also admitted at the preliminary hearing of David Daleiden and Sandra Merritt of the Center for Medical Progress that the baby’s head could be procured attached to the baby’s body or “could be torn away.”

“That is an especially gruesome admission, but it begs the question: how did they get these fully intact human children?” says Peter Breen of the Thomas More Society, which is representing Daleiden at the hearing.

“If you have a fetus with an intact head and an intact body, and intact extremities, that is something that would indicate that child was born alive, and then had their organs cut out of them, or that that child was the victim of an illegal partial-birth abortion,” he told LifeSiteNews. “Both of these are gruesome and violent acts.”

CMP’s Daleiden and Merritt are charged with 15 felony counts of illegal taping of confidential information in connection with undercover videos they released in 2015 after a three-year covert investigation into the buying and selling of baby body parts, which is a felony.

The covertly recorded videos exposed StemExpress as the go-to in California for Planned Parenthood’s trafficking in baby body parts, and the biotech company cut its ties with Planned Parenthood shortly after these were released.

CMP’s legal team is arguing in the preliminary hearing that the law does not consider conversations that can be overheard confidential and that covert recording is allowed when done to investigate violent crimes.

On Thursday, the court saw video clips of the StemExpress CEO, identified as Doe 12, meeting in May 2015 with Daleiden and Merritt, who were posing as owners of a biotech company.

Doe 12 says in the video there’s a great demand for “raw fetal tissue,” and that the “insanely fragile” neural or brain tissue is best shipped in a “whole calvarium,” or head, whereupon Daleiden says, “Just make sure the eyes are closed.”

Doe 12 was far less forthcoming in her testimony Thursday, as Breen noted.

“Yeah,” laughs Doe 12, “Tell the lab techs its coming…it’s almost like they don’t want to know what it is.”

“One thing we’ve observed throughout these proceedings is that these witnesses were much more candid when they spoke to David and Susan on the undercover video than they are on the stand,” he told LifeSiteNews.

David Daleiden Wants Kamala Harris’ Search Warrant Thrown Out So Case Against Him Will be Dismissed

The Center for Medical Progress investigation exposed numerous atrocities inside Planned Parenthood abortion facilities across the U.S.

Before Kamala Harris was a Democratic presidential candidate and a U.S. senator, she prosecuted undercover journalist David Daleiden for exposing Planned Parenthood’s baby body parts trade.

On Wednesday, lawyers for the Center for Medical Progress leader filed a motion asking the court to throw out the search warrant that Harris ordered in 2016 on his home. The raid and the unreleased videos that Harris’s office seized led to Daleiden’s prosecution on 15 felony charges related to the privacy of the people he recorded.

“As a political favor to Planned Parenthood, Kamala Harris’ Attorney General’s office blatantly ignored black-letter California law protecting a citizen journalist’s unpublished materials and falsely alleged probable cause for a search warrant, over and above the objections of career law enforcement professionals,” his lawyers said in a statement to LifeNews.com.

They slammed the search warrant as a “sham” resulting from Harris’s close ties to Planned Parenthood.

“Internal email communications released between the Attorney General and Planned Parenthood shows an investigation conducted and overseen by Planned Parenthood and allied activist groups as the basis for a sham search warrant,” the lawyers wrote in the motion.

They produced evidence in the motion that several state investigators did not believe that the search warrant was accurate or based on probable cause. Despite this, Harris’s office seized unpublished videos and other documents from Daleiden’s computers, hard drives and other documents with “sensitive, unpublished editorial information,” according to the court document.

“It appears that the investigative staff had to be coerced into serving a search warrant that they opposed,” the motion states. “This is overwhelming evidence of bad faith.”

They said one agent was so strongly opposed to the move that he took “stress leave” so that he would not have to get involved.

The motion also notes that the Los Angeles Police Department refused to take down a report by one of the people Daleiden recorded because the recording was made “in a public restaurant,” not in private.

Other evidence suggests similar situations, including two of the people recorded by Daleiden admitting “that their conversations at restaurants could be overheard.”

If a judge grants the request and throws out the warrant, the charges against Daleiden would have to be dismissed.

“This is not an honest prosecution but rather a political favor to Planned Parenthood,” his lawyers said in the motion.

Judge Upholds David Daleiden’s 1st Amendment Right to Expose Planned Parenthood Aborted Baby Part Sales

Undercover investigator David Daleiden has been vindicated in court today against the bogus lawsuit Planned Parenthood filed after his videos exposed the abortion giant for selling aborted baby parts.

Daleiden has maintained from the beginning that he and the Center for Medical Progress followed all applicable laws in the course of its investigative journalism and that the lawsuit was politically-motivated retribution as opposed to a suit based on legitimate damages.

In a big victory for the First Amendment freedoms of citizen journalists on Wednesday evening, a federal judge in San Francisco indicated his intent to decisively cut back Planned Parenthood’s retaliatory lawsuit against The Center for Medical Progress for the undercover videos documenting Planned Parenthood’s sale of aborted baby parts.

In his tentative ruling, which he instructed the parties to treat as if it were substantially final, Judge William Orrick III rejected Planned Parenthood’s false and long-running smear that accused CMP citizen journalists, including David Daleiden, of attempting to incite “threats” and “violence” by publishing the undercover videos.

Judge Orrick wrote he was “inclined to exclude from the case all damages that stem from third parties’ reactions to the release of the video recordings as impermissible damages barred by the First Amendment absent a defamation claim.”Judge Orrick left in place only “damages for investigating intrusions” into Planned Parenthood’s space, and “improvements to access-security measures for conferences and facilities,” as well as nominal and statutory damages.

David Daleiden, CMP founder and project lead, told LifeNews: “Now that all the facts, evidence, and testimony are in, even Planned Parenthood’s favorite judge refuses to buy into the abortion giant’s fake news and lies about the honest motives and protected speech of pro-life citizen journalists. Planned Parenthood is a government-sponsored crime syndicate selling baby body parts like widgets on an assembly line and should only appear in federal court as a criminal defendant.”

Planned Parenthood sought more than $20 million in damages, but the Obama-appointed judge eviscerated that far-reaching request. The ruling significantly downsizes Planned Parenthood’s lawsuit, reducing potentially over $20 million at issue to less than $100,000.

According to a CMP statement to LifeNews, the “ruling affirms that citizen journalists exercising their First Amendment rights to speak and publish cannot be held liable for any bad actions taken by others in the free marketplace of ideas, absent a clear showing of defamation or intent to incite imminent lawless action. Planned Parenthood could provide no evidence or testimony in the case to back up either accusation, and so a lawsuit that was once an avalanche of charges has been reduced to essentially a trespassing dispute.”

Judge Orrick previously faced scrutiny presiding over the case because of his history founding, promoting, and donating to a Planned Parenthood clinic in San Francisco run by Plaintiff Planned Parenthood Northern California. That he would rule so strongly against Planned Parenthood speaks volumes.
